Terms of Service (E-LMS)

  1. Agreement

By using E-LMS (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

  1. Provider and Jurisdiction

E-LMS is governed by the laws of Namibia. Any disputes will be subject to the exclusive jurisdiction of the competent courts in Namibia unless mandatory consumer protection law provides otherwise.

We apply the EU General Data Protection Regulation (GDPR) where applicable. Personal data collected by the Service is stored on servers located in Germany.

  1. Accounts
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate information when registering.
  • Self-service account deletion is supported; see the Privacy Policy for details.
  1. Acceptable Use

You agree not to use the Service for illegal activities, to infringe others' rights, to distribute malware, or to abuse the platform.

  1. Payment and Billing

Where paid features are offered (e.g., credit purchases), payment processing is handled by third-party providers (e.g., PayPal). Billing terms, refunds, and finalization of purchases are governed by the applicable payment provider and any separate purchase agreement.

  1. Intellectual Property

All intellectual property rights in the Service and its contents remain with E-LMS or its licensors. You are granted a limited, non-exclusive license to use the Service according to these Terms.

  1. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, E-LMS disclaims all warranties, whether express or implied.

  1. Limitation of Liability

To the extent permitted by applicable law, E-LMS shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

  1. Modifications

We may modify these Terms from time to time. We will publish the updated Terms and the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
